These Terms of Service ("Terms") govern your access to and use of the website and services provided by Media Partners LLC ("Scale Media Partners," "we," "us," or "our"), an AI-powered marketing agency located in West Palm Beach, Florida.
Scale Media Partners provides AI-enhanced digital marketing services including strategy, paid advertising management, lead generation systems, content optimization, and related consulting. All services are subject to separate written agreements or proposals.
IMPORTANT: We do not guarantee specific results, leads, cost per lead, ROI, ad placements, or any particular outcomes. Marketing performance depends on numerous factors including budget, creative quality, competition, industry, platform policies, website conversion rates, and execution. Any projections or estimates provided are illustrative only and not guarantees of future performance.
Clients are responsible for providing accurate information, timely feedback, access to necessary accounts and data, and for the quality and legality of their offers, creative assets, and business practices. We are not responsible for delays caused by client-side issues.
Upon full payment, clients typically own the creative assets and campaign structures we develop specifically for them. We retain rights to our methodologies, AI models, processes, and any pre-existing intellectual property. Campaign data and learnings may be used in anonymized, aggregated form to improve our services.
To the maximum extent permitted by law, our total liability arising out of or related to our services shall not exceed the total fees paid by the client in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.
Either party may terminate services as outlined in the applicable service agreement. Upon termination, all outstanding fees become due immediately.
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved through binding arbitration in Palm Beach County, Florida, or in the state or federal courts located there.
We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the updated Terms.
